Shipping & Returns

1. You must request an RMA (Return Merchandise Authorization) form by loging in to your account: www.laterem.com/me/account/ , Select the order you want to return, click on Request RMA and fill out the information in the form provided. Returns will not be accepted without the RMA.  

Your RMA will be processed within 2 business days of submitting your request.

2.15% restocking fee is assessed on all returns.

3. The customer is responsible for all return shipping charges and arrangements - you can choose any carrier you'd like. Please note returns are also accepted at our showroom.

4. The following items are final sale and can not be returned: samples, clearance items, items marked as FINAL SALE. Shipping charges are non-refundable.

5. All returns must be in their original packaging and in the condition in which they were received. Credit will not be issued for any items returned to us broken. It is imperative that the returned boxes are packaged well. We recommend using a trackable shipping method. Refunds will not be issued for items damaged in return transit or for returns that are never received.

6. Once we receive your return, your refund will be processed within 7 business days.

7. Samples and sale items are not returnable, and shipping charges are non-refundable.

Unforseeable circumstances

Laterem will not be held responsible for any delays or failures to fulfill our obligations caused by events outside our reasonable control. These may include natural disasters (such as fires, floods, earthquakes, or storms), government actions, labor strikes, transportation issues, material shortages, pandemics, or other unforeseen circumstances.

If any such event occurs, Laterem’s delivery timelines will be extended by the length of the delay. If the delay lasts longer than forty-five (45) days, Laterem may choose to cancel the affected order(s), in whole or in part, without penalty or liability.

 

Customer Solvency

By placing an order, you confirm that you are financially solvent and capable of paying for your purchases as they become due. You also confirm that there has been no significant negative change in your financial situation since providing any credit or financial information to Laterem.

 Severability

If any part of these Terms is found to be invalid or unenforceable by a court, the remaining sections will still apply and remain fully effective.

Attorneys’ Fees

If a dispute arises out of or relates to a purchase from Laterem and we are the prevailing party, Laterem will be entitled to recover reasonable attorneys’ fees and related costs.

Waiver of Set-Off Rights

You agree not to withhold, offset, or deduct any amounts owed to Laterem for any reason. Payments must be made in full as stated in your order agreement or invoice.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York. Any legal action or dispute related to these Terms must be filed in a court located in Manhattan, New York City. By purchasing from Laterem, you consent to the jurisdiction of these courts for any related matters.

Entire Agreement

These Terms, together with any other applicable policies or conditions on the Laterem website, represent the complete understanding between you and Laterem. They replace any previous communications, agreements, or understandings, whether written or verbal, regarding your purchase or use of our services.
